Courts in Georgia divide visitors into three categories: invitees, licensees, and trespassers. A property owner’s duty of care is different for each category. Knowing under which category you fall into can help shape the potential outcome of your case.

Invitees: Given the highest duty of care

Invitees are visitors who enter a property for a purpose that benefits the owner, usually a business reason. Shoppers, tenants and customers all fit into this category. Property owners owe invitees the highest duty of care, which includes:

  • Conducting regular inspections
  • Repairing hazards in a timely manner
  • Posting clear warnings about hidden dangers

If you fall on a slippery supermarket floor, your claim is strongest when the store either failed to inspect or ignored a hazard that could have been fixed.

Licensees: Given a lesser duty of care

A licensee is someone who enters with the owner’s permission but for their own reasons. Social guests and door-to-door visitors are common examples. Owners owe them a lesser duty, which means they must avoid causing willful or wanton harm but are not required to search for hazards. If you stumble on a loose rug during a party, you may only succeed if your host knew the rug was dangerous and disregarded the risk.

Trespassers: Given the lowest duty of care

Trespassers enter without consent or lawful right. Georgia law imposes almost no duty toward them, apart from avoiding intentional harm. Children may be an exception when an attractive nuisance such as an unsecured swimming pool lures them onto the property.
